What is the difference between overtime and extra work?
In this calculator, overtime or extra work means working time above the entered agreed target hours. That is a calculation definition for the target/actual comparison. Whether it creates a claim for pay, time off or a German working-time issue depends on contract, collective agreement, works agreement and the facts.
Does overtime always have to be paid?
No, not automatically. Whether overtime is paid, compensated with time off or credited to a time account depends on the effective agreement and circumstances. BGB section 612 can indicate remuneration where work can only be expected against remuneration.
When does it become critical under German working-time law?
A workday above 10 hours is especially critical. Values above 8 hours per working day also need compensation so the average does not exceed 8 hours in the statutory period. Night work has additional rules.
What belongs in a working-time account?
A working-time account should show at least starting balance, target hours, actual hours, plus/minus hours, compensation, corrections and the new balance. Whether and how an account may be used should be regulated by contract, collective agreement or company rules.
Which working times must be documented?
Under ArbZG section 16, time above 8 hours per working day must be recorded and retained for at least two years. Independently, the general duty to record working time goes beyond overtime only; clean records should include start, end and breaks.
Can I use the overtime calculator for payroll?
Yes, as preparatory orientation. The calculator provides target/actual difference, account balance and a payout scenario. Actual payroll still requires checking contract, premium rules, tax/social security treatment and internal approval.
